Terms of Service

Please read these Terms of Service carefully before using Shortlisted. By creating an account or using any part of the service, you agree to be bound by these terms. If you do not agree, do not use the service.

1. The service

Shortlisted provides AI-powered tools to help job seekers tailor resumes, generate cover letters, prepare for interviews, negotiate salaries, optimize LinkedIn profiles, and related career services (the "Service"). Shortlisted also operates an employer talent marketplace where verified employers can search opted-in candidate profiles.

[YOUR_LLC_NAME] ("Shortlisted", "we", "us") operates the Service. These Terms govern your access to and use of the Service.

2. Eligibility and accounts

  • You must be at least 16 years old to use the Service
  • You must provide accurate, current, and complete information when creating an account
  • You are responsible for maintaining the confidentiality of your password and for all activity under your account
  • You may not create more than one account per person to circumvent usage limits
  • Employer accounts must represent a legitimate business entity and may not be used for personal job seeking

3. AI-generated content — important disclaimer

The resume content, cover letters, LinkedIn rewrites, interview questions, salary data, and all other AI-generated output produced by Shortlisted are provided for informational and drafting assistance purposes only.

  • No outcome guarantee: Shortlisted does not guarantee that using our Service will result in job interviews, job offers, salary increases, or any specific employment outcome. Results vary based on factors entirely outside our control including market conditions, employer preferences, and individual qualifications.
  • AI can make errors: AI-generated content may contain inaccuracies, outdated information, or suggestions that are not appropriate for your specific situation. You must review all AI output carefully before using it.
  • You are responsible for accuracy: You are solely responsible for ensuring that your resume and other application materials are truthful and accurate. Do not submit AI-generated content that contains false information about your qualifications, experience, or education.
  • AI disclosure: If an employer, platform, or other party asks whether your application materials were assisted by AI tools, you should answer honestly. Shortlisted is not responsible for any consequences arising from your representations about your application materials.
  • Salary data is approximate: Compensation ranges provided by our Salary Coach feature are estimates based on publicly available data and AI analysis. They are not legal or financial advice and should not be the sole basis for any employment decision.

4. Your content and data

  • You own your content: You retain all ownership rights to the resume content, work history, and personal information you submit to the Service.
  • License to us: You grant Shortlisted a limited, non-exclusive license to process your content solely to provide the Service — generating tailored documents, running ATS analysis, and matching with employers (if you opt in to the talent pool).
  • No AI training: We do not use your resume content or personal data to train AI models.
  • Talent pool opt-in: Participation in the employer talent pool is entirely voluntary. You can opt in and out at any time from your Settings page. While in the talent pool, your profile is anonymized (name shown as first initial + last name) until you respond to an employer inquiry.
  • Accuracy: You warrant that information you submit does not infringe third-party rights and is not false, misleading, or fraudulent.

5. Subscriptions, billing, and refunds

  • Free tier: Free accounts receive a limited number of generation credits. Credits do not roll over or expire while the account is active.
  • Pro subscription: Billed monthly at the current advertised rate. Subscription renews automatically unless cancelled.
  • Lifetime access: A one-time payment for perpetual access to the Service at the feature level available at purchase. We reserve the right to add premium features to a higher tier in the future; existing lifetime access holders will retain all features they had at purchase.
  • Cancellation: You may cancel your Pro subscription at any time from the Billing page in your account. Access continues until the end of your current billing period. No partial refunds for unused portions of a billing period.
  • Refund policy: We offer a 7-day money-back guarantee for new Pro subscriptions. If you are not satisfied within the first 7 days, contact support@shortlisted.io for a full refund. After 7 days, refunds are at our sole discretion.
  • Price changes: We may change subscription prices. We will give you at least 30 days' notice before any price increase takes effect on your existing subscription.
  • Taxes: Prices are exclusive of applicable taxes. Sales tax may be added depending on your location.

6. Employer accounts and placement fees

Employer accounts are subject to the separate Employer Placement Agreement, which must be accepted before accessing candidate profiles or making hires through the platform. Key terms:

  • Placement fee: A placement fee equal to the current advertised percentage (currently 12%) of the hired candidate's first-year base salary is due upon confirming a hire made through Shortlisted.
  • Fee triggers: The placement fee applies when an employer hires a candidate they first contacted through the Shortlisted platform within the lookback period defined in the Employer Placement Agreement.
  • 90-day guarantee: If a placed candidate leaves within 90 days for reasons within the employer's reasonable control, we will provide one free replacement search. The placement fee is not refunded.
  • Candidate confidentiality: Employer accounts may not use candidate data obtained through Shortlisted to contact candidates outside the platform for a period of 12 months following initial contact.

7. Prohibited uses

You may not use the Service to:

  • Create false, fraudulent, or misleading application materials
  • Impersonate another person or misrepresent your qualifications to employers
  • Scrape, copy, or extract content from the platform using automated means
  • Reverse-engineer, decompile, or attempt to access our source code or AI models
  • Share your account credentials with others
  • Use the Service to harass, spam, or contact employers or candidates outside permitted flows
  • Circumvent usage limits or billing by creating multiple accounts
  • Use generated content in a way that violates applicable employment laws or equal opportunity regulations

8. Intellectual property

The Shortlisted platform, interface, logo, and underlying technology are owned by [YOUR_LLC_NAME] and protected by copyright, trademark, and other intellectual property laws. You may not use our name, logo, or branding without prior written permission.

AI-generated output (resumes, cover letters, etc.) produced for you is licensed to you for personal use. You may use it freely for your own job applications. You may not resell, sublicense, or use it as training data for AI systems.

9. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, [YOUR_LLC_NAME] AND ITS OFFICERS, EMPLOYEES, AND CONTRACTORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOST EMPLOYMENT OPPORTUNITIES, OR LOSS OF DATA, ARISING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE.

Our total liability to you for any claim arising from these Terms or your use of the Service is limited to the greater of (a) the amount you paid us in the 3 months preceding the claim or (b) $100 USD.

10. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR THAT ANY AI-GENERATED CONTENT WILL BE ACCURATE, COMPLETE, OR SUITABLE FOR ANY PARTICULAR PURPOSE.

11. Termination

We may suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or for any other reason at our discretion with reasonable notice. You may delete your account at any time from Settings. Upon termination, your access ends and your data is deleted according to our Privacy Policy.

12. Disputes and governing law

These Terms are governed by the laws of the State of [YOUR_STATE], without regard to conflict of law principles. Any disputes will be resolved through binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may bring claims in small claims court for disputes within that court's jurisdiction. You waive the right to participate in class action lawsuits or class-wide arbitration.

13. Changes to these terms

We may update these Terms at any time. For material changes, we will notify you by email at least 14 days before they take effect. Your continued use after the effective date constitutes acceptance. If you disagree with updated terms, you may cancel your subscription and delete your account.
